The prosecution, or defense, of court cases involving scientific issues has numerous facets that must be successfully identified in advance and properly integrated into a convincing argument. Applicable state and Federal regulations must be understood in detail. Industry standards, prudent practices, and standard operating procedures must be carefully analyzed. Scientific methods, data analyses, and technical publications must be scrutinized. In addition, certainly, litigation causative factors must be documented, assessed, and possibly challenged. This type of technical research and analysis is critical to any lawsuit involving technical issues, and provides a factual basis for your final technical strategy.

Attorneys can more easily identify an expert for a specific technical issue within their case, but identification of an expert in broad technical research and analysis that provides a sound technical strategy is much harder. CCS offers a wide range of technical expertise in the areas of chemical hazards, occupational safety and health, and environmental compliance. Our broad range of technical capabilities, services, and products enable us to stay current with the latest regulations, technical issues and resources, and chemical customer expectations. The main focus of our business is to pinpoint problems that lead to solutions. We have successfully applied this experience, and technical expertise in previous litigations.

A sample of our case experiences follows:

1. Successfully defended our client in a $65 million lawsuit.CCS provided case strategy suggestions, expert research and analyses, disposition reviews, expert reports (including a detailed root cause analysis), depositions, other defense expert preparation support, and technical critique of plaintiff’s expert report. This case was dismissed via Summary Judgment.

2. Successfully prosecuted a $6 million wrongful termination lawsuit. CCS provided a complete case strategy for two young attorneys, the opening and closing arguments (with accompanying charts), technical research and analyses, and expert testimony.The jury awarded the plaintiff $6 million from one of the most prestigious research laboratories in the U.S.

3. Successfully defended a homeowner against a citation from a local agency claiming groundwater contamination. CCS provided case strategy suggestions, technical research and analyses, and an expert report (including photographic evidence). The judge dismissed the charges outright.

4. Successfully prosecuted a wrongful death lawsuit. CCS provided the case strategy, technical research and analyses, and expert report (including a root cause analysis). This case was subsequently settled out of court.

Red Star Expert Report and Deposition Evaluations
Prior to deposition or testimony,  we provide the attorney with insight into the specific points of strength and weakness. Supplemental research provides the data to challenge, or supplement, the report or deposition strengths or weaknesses, depending upon the side represented. In one previous case, CCS provided detailed Expert Report assessments that enabled our clients' attorneys to successfully challenge two opposing expert reports and have both authors not recognized by the Court as experts.

Our technical deposition evaluations, assure that our clients and their attorneys have every opportunity to strengthen their technical position. CCS currently maintains the largest database available on occupational and environmental chemical regulations and hazardous chemical effects. These databases are utilized for a wide range of Hazardous Materials Management services. They provide a solid foundation for many technical litigation cases. Our staff is expert at supplemental technical research and analyses. CCS prior experience in Occupational Safety and Health, Environmental Compliance, and Employee Education add to our abilities to provide unusually effective technical research. Root Cause Analyses have proven particularly effective when evaluating causative factors for lawsuits. Research findings can either be presented simply as "advisory documents," or formally as an Expert Report. CCS draws upon our previous experience in publishing numerous chemical health and safety books when composing our Expert Reports. Our writing style is clear and concise. Our reports also effectively incorporate data tabulations and graphics to illustrate and emphasize concepts and principles. We also have developed effective strategies for balancing the development of a strong Expert Report while minimizing information conveyed to opposing attorneys.

Red Star Technical Expert Testimony
President and CEO, Dr. George R. Thompson, provides expert testimony. Dr. Thompson received his Ph.D. in toxicology and pharmacology from Oregon State University in 1969. After 15 years of toxicological and compliance research and management in a cross-section of industry, he established The Forum for Scientific Excellence, Inc. FSE eventually became CCS. Dr. Thompson has pursued interests associated with environmental and chemical compliance research. He has authored or compiled numerous technical publications and lectured on environmental issues. His career interests have consistently kept him interacting with corporate attorneys, public advocates and private counsel. His technical knowledge, experience, and personal abilities have proven to be strong assets as an expert witness.

Red Star Witness Preparation Assistance
CCS Expert Witness services all contribute to our abilities to assist an attorney in the preparation of other expert witnesses for deposition or testimony. CCS can effectively manage the technical presentations of YOUR case, assuring you a winning strategy!

Cases currently in progress include:

1. Prosecution of a worker exposure (to pesticides) case. To date, CCS has provided case strategy suggestions, deposition reviews, technical research and analyses, expert report (including a root cause analysis and exposure timeline), and is scheduled for a deposition.

2. Prosecution against an automobile manufacturer for chemical exposure of a research scientist/employee that caused terminal disabilities. CCS has thus far provided case strategy suggestions and is scheduled for deposition reviews, technical research and analyses and possibly expert testimony.

3. Prosecution against an underground storage tank remediation company on behalf of an exposed homeowner. CCS to date has provided case strategy suggestions, a preliminary case success probability analysis, and is scheduled for deposition review, technical research analyses, and probably an expert report.
